Strategic session of the Government of the Russian Federation "On the development of the intellectual property sphere until 2036"
On January 27, 2026, a strategic session "On the development of the intellectual property sphere until 2036" was held at the Government of the Russian Federation under the leadership of the Chairman of the Government of the Russian Federation, Mikhail Mishustin. At the opening of the session, the Head of the Russian Government drew attention to the support measures for inventors:
- convenient conditions for registering intellectual property: applications can be submitted electronically (more than 80 percent in 2022), and the average processing time has been reduced to four months;
- small and medium-sized businesses can use the intellectual property collateral loan mechanism, and it is important to expand its use so that patents and trademarks become real economic assets that can not only generate income but also attract financing;
- Tax deductions are available for companies engaged in R&D, allowing them to deduct double the cost of equipment, materials, and employee training. In some regions, the "patent box" regime has been implemented, which reduces or eliminates the regional income tax on intellectual property.
As a result, the number of applications for inventions from individual entrepreneurs increased by almost a third in 2025. The number of trademark registrations increased by a quarter, mainly due to Russian companies and regional brands. The President of Russia has set a goal of increasing investments in fixed assets by at least 60% over the next five years, which means increasing the share of intellectual property in investments. According to Mikhail Mishustin, "It is important to support entrepreneurs who incorporate inventions into the economic cycle and expand cooperation between educational institutions, science, and business. This will ensure that the industry, key innovative sectors, and the social sphere do not depend on foreign suppliers, but rely on domestic solutions. As a result, intellectual property will become an economic asset."
The main presentations were made by the heads of three departments from the 10 federal executive authorities responsible for state policy and regulatory legal regulation in the field of intellectual property: Mikhail Reshetnikov, Minister of Economic Development of the Russian Federation; Valery Falkov, Minister of Science and Higher Education of the Russian Federation; and Yury Zubov, Head of Rospatent. During the discussion of the agenda items, which lasted less than two hours, the Vice Premiers of the Russian Government, A.V. Novak and D.N. Chernyshenko, L.S. Gumerova, Chair of the Federation Council Committee on Science, Education, and Culture, A.E. Repik, Co-Chair of Business Russia LLC, Yu.V. Popelysheva, Director of the Legal Department at Yandex, D.V. Livanov, Rector of the Moscow Institute of Physics and Technology, and M.M. Kotyukov, Governor of the Krasnoyarsk Territory, all provided comments.
At the same time, the issues discussed and the decisions made as a result of the discussion were of a private nature and mainly concerned the activities of Rospatent, with reference to the Action Plan ("road map") for implementing the mechanism for managing systemic changes in the legal regulation of business activities "Transformation of the Business Climate" "Intellectual Property", approved by Order No. 2027-r of the Government of the Russian Federation dated August 3, 2020, as a strategic document, although it is not a strategic document in content.
This document does not correspond in its structure and content to the goals and objectives set by the President of the Russian Federation for the formation and further development of the intellectual property market. In order to implement the Unified Plan for Achieving the National Development Goals of the Russian Federation until 2030 and beyond 2036, we must achieve a tenfold increase in the comprehensive index of technological independence of the Russian Federation over the next five years, from 10.7% in 2025 to 100% by 2030.
In order to ensure technological leadership and sovereignty, it is necessary to develop and adopt a Strategy and program for the development of the national and Eurasian intellectual property market, which should include priority measures in the following areas:
- preparation and adoption of a package of measures to improve legislation (exclusion of R&D and intellectual property from the service sector; removal of barriers in isolation from each other other subject areas of regulation in the fields of R&D (scientific activity, scientific and technical activity, innovation activity) and intellectual property (legal protection, commercialization, legal protection); making appropriate amendments (additions) to the legislation on the contract system and public-private partnership for the active use of the mechanism of public-private partnership in contractual relations. performing R&D);
- creation of a centralized system of state regulation in the field of intellectual property in the Russian Federation by adopting a decision on the centralization (transfer) of state regulation functions (on the development and implementation of state policy and legal regulation) in the field of intellectual property in relation to all categories of intellectual property objects on the basis of a single federal executive authority in the field of intellectual property, with its subordination to the Government of the Russian Federation;
- adjustment of strategies, programs, national plans and projects for innovative development, government contracts for R&D in terms of target indicators: transition from information indicators for evaluating the effectiveness of R&D (publications, patents, seminars) to economic indicators for creating added value (number and value of intangible assets, IP share in pricing, IP share in asset capitalization, the share of IP in attracting investments, the share of royalties, etc.) with additional capitalization of intellectual property through intangible assets of the treasury and enterprises / organizations executing contracts / agreements, which will ensure a balance of interests in the "triad" (author – rightholder – investor) and significantly increase the reassessment of the national wealth of Russia (GOST R 58086 as amended No. 1-2026 Intellectual Property. Distribution of intellectual rights between the customer, the contractor, and the author for the protected results of intellectual activity created and/or used in the course of R&D, GOST R 58591-2019 with amendment No. 1-2026 "Intellectual Property. Accounting and Intangible Assets");
- significant adjustments to the policies of organizations and enterprises, taking into account the patterns of development of the intellectual property market, when choosing the method of legal protection for the results of intellectual activity created in the scientific and technical field with budgetary financing (development of the Eurasian patenting system; active use of non-patented methods of legal protection for reporting documentation as works of science (GOST 34831-2022 "Intellectual Property. Scientific works"), objects of copyright, related rights, and trade secrets (know-how); restoration of the institution of scientific discoveries as part of intellectual property objects - GOST 34887-2022 "Intellectual Property. Scientific Discoveries");
- development of mechanisms and indicators for monitoring the use of previously obtained RID (preceding intellectual property) at all stages of the innovation process, from fundamental research to development and testing of technologies and their use in production (innovations). The use of previous intellectual property should be accompanied by the conclusion of a license agreement with the copyright holder (on a remunerative basis, if the RID was created using extrabudgetary funds), which will allow the intellectual property to be included in the pricing of final products, works, and services, ensure a balance of interests in the "triad" (author, copyright holder, and investor), and motivate all participants in the innovation process to improve the created technologies for the production and sale of competitive products, and increase the business's share in co-financing R&D;
- development and adoption of measures to increase the liquidity of intellectual property in the financial market (GOST 35248-2025 Intellectual Property. Management in a Credit Institution; GOST 35249-2025 Intellectual Property. Management in the Stock Market; GOST R 70484-2022 Intellectual Property. Risk insurance", including for preferential loans secured by intellectual property), as well as the expansion of tax benefits and preferences for all categories of intellectual property objects when they are used in the interests of NTR;
- further development of standardization as a condition and effective mechanism for harmonizing legal regulation, taking into account the creation of the world's first national system of standards for "Intellectual Property" in Russia (more than 30 standards), the active use of references to the application of national and interstate standards in the framework of norm-setting and law enforcement practices, and the creation of the ISO International Committee for "Intellectual Property";
- adoption of a package of measures to improve legal and economic literacy, professional development for managers and accounting services in the field of economics and intellectual property management (seminars and advanced training courses); training of professional personnel in this field (lawyers, economists, and managers) at a rate of 1 specialist per 10 researchers (changes to training programs and curricula at leading universities in all federal districts of the Russian Federation).
Taking these circumstances into account, on January 28, 2026, at a joint meeting of the Bureau of the Presidium, the Presidium and the Board of the All-Russian Public Organization "Association of Lawyers of Russia", in order to fulfill the task set by the President of the Russian Federation V.V. Putin on the further development of the intellectual property market as a condition for scientific and technological development, ensuring technological sovereignty and national competitiveness, in accordance with clause 3.1 of the Agreement on Cooperation between the Russian Academy of Sciences The Russian Academy of Sciences and the Association unanimously decided to include in the Association's Work Plan for 2026 the item "Participation in the preparation, together with the Russian Academy of Sciences, of a draft Strategy for the development of the intellectual property market until 2036."
