The journal was established in 2007 as a specialized informational, analytical, educational, and legal publication (Mass Media Registration Certificate No. PI FS 77–85946 dated September 26, 2023). The founder and publisher of the journal is the Republican Scientific Research Institute of Intellectual Property (RSRIIP) (OGRN 1067746146148, INN 7707575197).

Since 2010, the journal has been included in the List of Leading Peer-Reviewed Scientific Journals and Publications in which the principal scientific results of dissertations submitted for the academic degrees of Doctor of Sciences and Candidate of Sciences must be published.

By the decision of the Presidium of the Higher Attestation Commission under the Ministry of Science and Higher Education of the Russian Federation, effective November 1, 2022, the journal Intellectual Property Law was included, among 2,600 journals, in the list of peer-reviewed scientific publications (Category K2) in which the principal results of dissertations submitted for the academic degrees of Candidate of Sciences and Doctor of Sciences must be published under the new list of scientific specialties:

The digest was prepared by the Federal Council Committee for science, culture, education, healthcare and ecology jointly with NSRIIP.
The digest contains official documents of public authorities, scientific and public organizations, materials of conferences, round tables, seminars, letters to the President of the Russian Federation and to the Government of the Russian Federation on questions of preparation and enactment of Civil Code’s fourth part. The ending contains research and comments on the law and its particular parts by well-known scientists.
The “White book” is published for lawmakers and specialists on intellectual property. It would be interesting for both rights holders and wide audience, because today it is impossible to do business successfully without understanding the processes and standards in the field of intellectual property.

 

 

 

 


Аналитический доклад «О состоянии правовой охраны и защиты интеллектуальной собственности в Российской Федерации в 2007 году»On the State of the Legal Safeguard, Use and Protection of Intellectual Property in the Russian Federation in 2007-2014. Analytical Report

The present report is prepared at the Republican Scientific Research Institute of Intellectual Property (RSRIIP) in accordance with the plan of operation and publishing activity and decision of the Academic Council of RSRIIP. The given initiative on arrangement of the annual state report for the nation`s leadership was for the first time supported on March 12th, 2008 by the participants of scientific-practical conference “The Transition to the Innovation Economy through the Market of Intellectual Property”, being organised by the Accounts Chamber of the Russian Federation. According to the results of II All-Russian Competition, the draft of the state report for 2007 was recognised as the winner upon being nominated for the most effective development of the monitoring system on the right in the sphere of defence and protection of Intellectual Property in the Russian Federation, and in June 2008 was awarded the Diploma of the Federal Council of the Federal Assembly of the Russian Federation. The present report presents the monitoring results over the activities of more than 40 federal authorities of the government, state corporations and non-governmental structures on formation of the Intellectual Property market in Russia last year in comparison with the results of this work for 5 years, both at the federal level and at the regional one. The report is destined for the federal authorities of the government, the government bodies of the federal subjects of Russia, law enforcers and rightholders of Intellectual Property. Moreover, the report can be used upon organisation in CIS the intergovernmental data exchange on prevention and suppression of infringements in the sphere of Intellectual Property in accordance with the Decision of the Council of the Heads of Governments of CIS of May 25th, 2006, as well as upon arrangement of annual reports of Russia to UNESCO, WIPO and other structures according to international commitments had been undertaken.

 On the threshold of IV International Forum “The Innovation Development through the Market of Intellectual Property”, the first, following the adoption of the fourth part of the Civil Code of the Russian Federation, the glossary of terms and definitions in the sphere of Intellectual Property was prepared at the Republican Scientific Research Institute of Intellectual Property, and was published at OJSC Information and Publishing Centre “PATENT” in April 2012. 

 The multiplicity of resources of law, concurrently operating in Russia in the sphere of Intellectual Property and in principle comprising different approaches towards understanding, protection, use and defence makes this sphere the most collisional one, and that causes difficulty for understanding and effective rule making and law enforcement on the issues related to it. A range of national standards, adopted prior to taking effect of the fourth part of the Civil Code of the Russian Federation and operating in the sphere of Intellectual Property, does not conform to standards of the Russian legislation. It predetermined the necessity and topicality to draw up, in accordance with the programme of national standardisation in 2011 in RSRIIP by request of Rosstandart, in the corresponding national standard as the tool for resolution of legal collisions and improvement of effective rule-making, safeguard and law-enforcement activity in the sphere of Intellectual Property. The present glossary includes assorted terms and definitions, conventionally related to the structure of the mentioned national standard “Intellectual Property. Terms and Definitions”, and which are given by considering numerous legal collisions in this sphere, as a rule, in copyright edition, not being contradictory to the rule of law, but enabling to settle these collisions effectively.
