The AYUR Commission on Intellectual Property at the site EAPO

On July 04, 2023, a regular meeting of the Commission of the Association of Lawyers of Russia on Intellectual Property (in person, including online participation format) was held at the site of the Eurasian Patent Organization of the organization, chaired by the Chairman of the Commission, the Scientific Director of the RNIIIS V.N. Lopatin, with the participation of the President of the Eurasian Patent Office, member of the Commission G.P. Ivliev; invited head Federal Service for Intellectual Property Yu.S. Zubov; Director of FSBI FIPS O.P. Neretin; Director of FSBI FAPRID S.Y. Fabrichny.

 On behalf of the Government of the Russian Federation No. P9-18895 dated 06/23/2023, representatives of the Government of the Russian Federation, the Ministry of Economic Development of the Russian Federation and the Ministry of Education and Science of the Russian Federation were also invited to the meeting of the Commission.

The key topic of discussion on the agenda was the issue of centralization of state regulation functions and optimization of administrative processes among more than 20 federal executive authorities (FOIV) in the field of intellectual property in the Russian Federation, where, in fact, there is competition between departments instead of competition between economic entities on these issues.

Based on the results of an active discussion of the report of Lopatin V.N., taking into account the fact that this issue in modern conditions is of fundamental importance for ensuring national competitiveness and technological sovereignty, the effectiveness of the processes of Eurasian integration, and attempts were repeatedly made to solve it in 2011-2018, the members of the Commission agreed on the need to draft a decree of the President of the Russian Federation and a Government Resolution Of the Russian Federation to resolve issues:

1)    centralization (transfer) of the functions of state regulation of FOI (for the development and implementation of state policy and regulatory regulation) in the field of intellectual property in relation to all categories of intellectual property objects on the basis of a single federal executive authority subordinate to the Government of the Russian Federation;

2)    determining the list of FOI whose activities on administrative issues (including state accounting, control and supervision) in the field of intellectual property, this body will coordinate;

3)     determining the list of FOI with which this intellectual property management body will interact.

In this connection, the direction of the appeal with an analytical note to the Administration of the President of Russia and the Government of the Russian Federation was approved.

Following the discussion of the issue "On making adjustments to the regulatory and program documents of the Russian Federation on the exclusion of R&D and intellectual property from the service sector, followed by the assignment of R&D to work and the allocation of the intellectual property economy to an independent market sector", according to the report of S.V. Maksimov, Deputy Chairman of the Commission, Adviser to the Head of the FAS of Russia, it was decided to send proposals to The Government of the Russian Federation on the establishment of a working group to address this issue.
