In the Academic Council of RSRIIP
On the Management of Intellectual Property within the framework of the Technological Platform and the Regional Innovation Cluster
On September 12-13, 2013 the expanded visiting session of the RSRIIP Supervisory Board and Academic Council was held in St. Petersburg. The choice of the venue was made in connection both with a great deal of scientific potential of the northern capital (more than 55 thousand of doctors and candidates of science and 200 thousand of researchers live and work there) and with the available regional experience in settling topical issues on the management of Intellectual Property as between the technological platform- the regional innovation cluster, as well as in the field of its customs protection.
The visiting session was attended by the heads of federal and national research universities,the heads of public authorities of several federal subjects of the RF, the heads of regional innovation clusters, enterprises and organisations – participants of regional innovation clusters, the heads of regional, foreign and international centres of Intellectual Property of the RSRIIP Corporation, the mass media representatives.
Upon consideration of the first issue on the agenda “ On the Model of the Management of Intellectual Property within the framework of the Technological Platform and the Regional Innovation Cluster” the reports were delivered by: Ms L.M. Ogorodova - the Deputy Minister of Education and Science RF, the Chairman of the technological platform “the Medicine of the Future”, Doctor of Medicine, Professor, Corresponding Member of the RAMS, the Honoured Worker of Science RF - Problems of the Management of Intellectual Property within the framework of the Technological Platform (by the example of the Technological Platform “The Medicine of the Future”); Mr S.M. Aldoshin – the Vice-President of the RAS, the Academician and Mr V.N. Lopatin, the Director of RSRIIP, Doctor of Laws, Professor – On the Risk Management in the Field of Intellectual Property within the framework of the Innovation Development Programme of the RAS; Mr Z.M. Golant - the Chairman of Board of Nonprofit Partnership «Medical and Pharmaceutical Projects the ХХI century» - Mechanisms of the Management of Intellectual Property within the framework of the Regional Innovation Cluster (by the example of St. Petersburg cluster of pharmaceutical and medical industry and radiation technologies).
By the results of consideration and discussion of the first issue on the agenda, the session participants made the following decision:
1. To support proposals contained in reports on the formation of the model of the Intellectual Property management within the framework of the technological platform and the regional innovation cluster. To submit the session materials to be considered at the round table «The Risk Management of Intellectual Property upon Implementation of Innovation Projects» being led by the Intellectual Property Corporation of RSRIIP jointly with the Committee for Industrial Policy and Innovations of the Government of St. Petersburg within the framework of the Congress Programme of the VI St. Petersburg International Innovation Forum on October 3rd, 2013.
2.To consider it being necessary and useful in the interests of the implementation of the Strategy for the Innovation Development of Russia for the period of up to the year 2020 within the framework of the joint operation with the Ministry of Economic Development of the Russian Federation, the Ministry of Education and Science of the Russian Federation and the Ministry of Public Health of the Russian Federation to generalise the positive experience of formation of mechanisms on the management of Intellectual Property within the framework of the technological platform «The Medicine of the Future» and St. Petersburg cluster of the pharmaceutical and medical industry and radiation technologies for working out on their basis as the pilot and standard management model on these issues for other technological platforms and regional innovation clusters.
3.To approve the performance indicators of science in the field of Intellectual Property as being the essential ones, to recommend to the Ministry of Education and Science of the Russian Federation and State Academies of Sciencies differentially taking into account the technical and humanitarian specialisation of scientific organisations and IHEs to use upon organisation and assessment of effeciency of their scientific activity.
4.To support the initiative of Southern Federal University on the formation, with participation of the Intellectual Property Corporation of RSRIIP, of the unified database of depositaries of scientific works being created in scientific organisations and IHEs within the framework of federal districts on the basis of federal universities.
To recommend towards this end when working out the economic and organisational model of interaction upon deposition of scientific works (the rightholders of exclusive rights on scientific works, scientific organisations and IHEs – federal universities – the Corporation of RSRIIP) to use more actively the possibilities to apply the national standard GOST R «Intellectual Property. Scientific Works».
To agree to the algorithm of discussion and consideration of the economic and organisational model of interaction upon deposition of scientific works:
• RSRIIP – SFedU (September, 2013);
• meeting of rectors of federal universities (October, 2013);
• sessions of councils of rectors of IHEs in federal districts (November, 2013);
• submission for consideration at the Ministry of Education and Science of the Russian Federation (December, 2013)
5. Taking into acount a considerable delay in personnel training in the field of law, economy and the Intellectual Property management, the absence of state educational standards on these issues and obvious insufficiency in these tasks` solution of the educational potential of RSAIP, to support the practice of RSRIIP in this field:
- establishment of chairs of Intellectual Property on basis of the leading IHEs in the Russian regions to train bachelors and holders of a master`s degree on the direction of 222000 «Innovatics» of the training profile 222000.62.04 «Innovations and the Intellectual Property Management»;
- conducting short-term courses and workshops on the professional development on the basis of sectoral IHEs and institutes (8 hours, 32 hours, 72 hours, 120 hours);
- organisation of additional education on the basis of federal IHEs (500 hours).
6. To endorse the concept of the project of the national standard GOST R.
«Intellectual Property. The allocation of intellectual rights between the customer, performer and the author on protected results of intellectual activity being created and/or used when carrying out research and development and the technological and production work».
To recommend to the working group of RSRIIP on the development of the project of the national standard to take into consideration the peculiarities of allocation of intellectual rights in co-operation of research activities at the level of the technological platform- the regional innovation cluster.
7. To support proposals of the National Technical Committee on standardisation «Intellectual Property» TC481 on the inclusion into the programme of the national and interstate standardisation for the year 2014 of the development and adoption of standards on the Intellectual Property management at the State Academy of Sciencies and at the University.
To recommend when developing projects of the stated standards to take into consideration the peculiarities of the Intellectual Property management in co-operation of Academies of Sciences and Universities at the level of the technological platform-the regional innovation cluster.
8. To offer to the Ministry of Education and Science of the Russian Federation and the Ministry of Economic Development of the Russian Federation to establish with participation of RSRIIP the working group on the development of requirements specifications on carrying out research activities on the subject «The Intellectual Property Management within the Technological Platform» and « The Intellectual Property Management within the Regional Innovation Cluster».
9. To prepare based on the session materials the special topical issue of the journal “The Right of Intellectual Property” (prior to November 01st, 2013).
10.To prepare and place the information following the results of the session on sites of RSRIIP, RAS and organisations-partners of RSRIIP and members of the RSRIIP Corporation (in the Russian and English languages (prior to October 1st, 2013).
The consideration of the second and the third issues on the agenda «Problems of Customs Protection of Intellectual Property within the framework of the Customs Union, Common Economic Space and WTO» and «On the Conception of the Project of the National Standard «Intellectual Property. Customs Protection» was being held within the joint session of the RSRIIP Academic Council with the Academic Council of St. Petersburg Branch of the Russian Customs Academy named after V.B. Bobkov with participation of heads and specialists of the customs authorities of the North-Western customs administration. The speakers on these issues were Mr A.Y. Chernysh – Prorector of scientific work of the Russian Customs Academy, Doctor of Military Science, Professor, the Honoured worker of Higher School of the RF and Mr V.N. Lopatin – the Director of RSRIIP, the Chairman of the National Technical Committee on standardisation “Intellectual Property” TC481, Doctor of Laws, Professor.
By the results of the consideration and a spirited debate when discussing the specified issues there was unanimously made the following decision:
1. To recognise it being topical the preparation on basis of submitted reports of the information note on the problems of the legal control of combating counterfeit, customs protection of exclusive rights of the rightholders to be directed to the FCS of Russia, the Ministry of Economic Development of the Russian Federation, the Government of the Russian Federation and the Houses of the Russian Parliament (prior to October 10th, 2013)
2. For the purpose of harmonisation of the legislative framework and enforcement practice common with the international practice and regulations to recommend the inclusion into plans of Research RCA and RSRIIP for years 2013-2014 of research works “Mechanisms for Resolving the Legal Challenges in the Field of the Legal Control on Combating Counterfeit, Customs Protection of Exclusive Rights of the Rightholders within the framework of the Customs Union, Common Economic Space and WTO”.
To draw special attention when conducting scientific research to effectiveness increase of available powers of the customs authorities, incl. to possibilities of opposition against counterfeit within the framework of combating contraband.
3.To recognise it being necessary the broadening of the list of the Intellectual Property objects in the Customs Register on the basis of counterfeiting and the abolition of monetary deposit of its provision on the part of the rightholders.
4.To endorse the project of the requirements specification on the development of the interstate standard «Intellectual Property. Customs Protection» taking into consideration comments and proposals expressed by the session participants (Annex №3).
5.To support proposals of the National Technical Committee on standardisation «Intellectual Property» TC481 on the inclusion into the programme of the national and interstate standardisation for the year 2014 of the development, public discussion and examination of the final edition of the project of the interstate standard for the Customs Union and EurAsEC «Intellectual Property. Customs Protection».
6. To establish a joint working group for preparation of the project of the interstate standard «Intellectual Property. Customs Protection» on basis of the National Technical Committee on standardisation «Intellectual Property» (TC481) on standardisation with participation of scientists of RSRIIP and the Russian Customs Academy, incl. St. Petersburg Branch of the RCA named after V.B. Bobkov (prior to November 1st, 2013).
7. To recommend to the Federal Customs Service to generalise the enforcement practice in the field of protection of the rights on results of intellectual activity by the customs authorities, incl. under the international co-operation, as well as, taking into account the declared support of this work as the priority direction for the years 2014-2020 on the part of the Secretary of State of the Union State RF-RB, to consider the possibilities of participating in co-financing the development of the interstate standard «Intellectual Property. Customs Protection» and its public discussion and examination within the framework of the Customs Union.
The outcome documents of the Academic Council will be used when considering the agenda of the VI St. Petersburg International Innovation Forum, in the work of Federal Ministries and regional public authorities, State Academies of Sciences, interstate authorities of the Customs Union and the customs authorities of the RF.
